I'm very sorry to hear that Dark Horse has caved in to Timbo's absurd legal threats and taken their online comic down. OTOH since paper copies are now for sale, perhaps I should buy one, since I enjoy their adaptation so much!

Right. I know there are one or two people who let their passion for the subject get the better of them and we have been pretty lenient so far. We allow most debates, even some of the heated ones, as long as noone gets hurt and all is made up. 90% of the time this works fine. This time someone left because of it and that will not do. Hence this FINAL warning.

There are people who do like this film, I am not one of them, but that doesn't mean that everyone with a comment towards the possitive has to be made to feel invalid.
Keep passions in check and we can carry on having some decent civilized discusion.

I am extremely disappointed to hear that Zoe has left. I sent her a pm after reading the altercations on this thread, but have yet to get a reply. I hope this serves as a costly lesson to everyone to treat every person on here with respect. I hope Zoe changes her mind and comes back soon.

(I hope is was not because of the lawsuit, which I firmly believes has absolutely no merit.) Also, does anyone know what monetary damages Mr. Hines is claiming in his suit? I am not a lawyer, but my understanding is that to be awarded damages in a copyright infringement lawsuit, you not only need to prove that your material was copied without your permission, but you also need to prove how much monetary damage you have suffered as a result of the copying. Right now, it is hard for me to visualize how Mr. Hines was monetarily damaged as a result of the Dark Horse comic. If there is anyone out there with any legal experience in these matters, it would be very educational to hear their opinions on this case. recumbentrider

If it were me, and it isn't  I'd let the courts decide before I pulled my webcomic down, if of course they did it for that reason. I mean, any version of War of the Worlds is going to have something in common lol  If I were the Dark Horse boys I wouldn't be worried to be honest.

Didn't someone post that Pendragon had a follow-up statement claiming Dark Horse said their artists were responsible for any plagiarism, not the company itself-- implying Dark Horse was washing their hands of it? Sounds like caving in to me, but then if that info is from Pendragon we certainly shouldn't believe it without independent confirmation. There are statutory damages and monetary damages. Statutory just means you must demonstrate your copyright was violated. Monetary means you must prove the commercial value of your property was damaged. Statutory damages are just fines-- a comparitively low amount. Monetary damages are based on how much money one might reasonably expect from a property, which can be anything from zero (this Internet post you're reading right now) to a very large amount of money; say, the movie "Pirates of the Caribbean: Curse of the Black Pearl". Lawsuits typically claim absurdly large amounts of money, *much* more than the plaintiff actually expects to win. Of course this is a negotiating tactic: "If we win this lawsuit we'll get $10 million, but if you pay us only $1 million right now we'll go away and leave you alone." Who would know? I rather suspect *only* Pendragon and Dark Horse know the details. I doubt either has a motive to make the details of any lawsuit or threatened lawsuit public. Note Pendragon has only claimed they have put Dark Horse on notice they *intend* to file lawsuit. In other words, it sounds as though they were just *threatening* a lawsuit. If they actually file one in court, it will be a matter of public record, and anyone could go and look it up. But it's not like court documents are routinely posted to the Internet... at least I don't think they are. I think someone would have to go down to the court house and pay to get a copy. I would *think* that could legally be posted to the Internet, tho, as it's a matter of public record and therefore not subject to copyright... but I could be wrong. Anyone could write up a letter and send it to someone threatening a lawsuit. I fact, there are probably standard "boilerplate" documents you could find in the library or on the Internet to make it *sound* like a lawyer wrote it; just plug in the name of the plaintiff and defendent and *presto*! One document full of ominous legalese. Now if Pendragon is actually *serious* about filing a lawsuit in court... they'll need to hire a lawyer. And that would, y'know, take *money*. So I'd say it would be quite a gamble for Pendragon to spend money on that, since if Dark Horse fights them they'll probably lose. So: Is Pendragon just hoping for some "Oh go away!" money from Dark Horse, or is this entire thing (as many or most here suspect) just a publicity stunt by Pendragon? Or is Timbo so deluded that he actually intends to pursue this matter into court? Well, i have just returned from my summer holiday. 10 days in Hungary. Budapest was great, and Lake Balaton, particularly Tihane was very, very pretty. I then log onto this great site, and its like "!!!!!!!!!!!". Anyway, that's all I have to say. Not much really, but then sometimes you don't need to say much, to say much, (if you know what I mean!). (?).

Then ask where his web poll went...... And not only that, his 'Did DH rip off PP' section is under supposed "Reconstruction"!  And now his web site is soley devoted to selling his movie!
